E-Sign Agreement

Please review this Fan inc. Debit Account eSign Agreement (the “Agreement”) carefully and retain a copy for your records.

This Agreement applies to all communications related to your application for and/or ownership of a Fan Inc. Debit Account and associated debit cards. Certain laws and regulations require us to provide certain information to you “in writing,” traditionally defined as being in paper form. With your consent, we may provide this information to you electronically and we may use electronic records and signatures in our relationship with you.

Definitions

“We,” “us”, “our,” “Fan inc. and “Fan Faktory, LLC.” means, its affiliates, its successors, its assigns, and its third-party service providers.

“You” and “your” means the person giving this consent, and also anyone else with ownership of or access to your Fan inc. Debit Account.

“Fan inc. Debit Account” means the bank account and associated debit card serviced by Fan Faktory, LLC and offered by Spur Security Bank®, a state chartered bank, as well as each and every other account, product, or service we provide that you apply for, own, use, administer, or access, either now or in the future.

“Communications” means each disclosure, agreement, statement, notice, record, and other document we provide to you, or that you sign or submit or agree to at our request.

“Access Device” means any electronic device you use to access your Fan Inc. Account and view electronic documents, either now or in the future. This includes but is not limited to a mobile device such as a tablet computer or a smartphone (such as an iPhone or Android), or a traditional computer such as a desktop or laptop.

1. Electronic Delivery of Communications and Use of Electronic Signatures

By consenting to this Agreement, you agree that we can send all Communications to you electronically by email, by text message, or by sending you an electronic notification that the Communications are accessible via Fan Inc. applications or websites. You agree that, whether or not you choose to view a Communication, a Communication provided electronically has the same meaning and effect as if provided in paper form. You agree that paper copies of Communications may not be mailed unless you specifically request it. You also agree that we may use electronic signatures and obtain them from you.

Your consent does not mean that we must provide Communications electronically, but instead that we may deliver some or all Communications electronically. Your consent will remain effective until expressly withdrawn by you.

Withdrawal of your consent will be effective only after we have a reasonable period of time to act upon your withdrawal. Please be aware that withdrawal of your consent may result in the termination of your ability to use certain Fan Inc. Debit Accounts.

To withdraw your consent or request a paper copy of a Communication, please contact us by email at support@faninc.com by phone at 877-958-2528. For the avoidance of doubt, requesting a paper copy of any Communication, in and of itself, will not be treated as withdrawal of consent to this Agreement.

2. Valid Email Address

It is important that you maintain a valid, active, and current email address so that we may contact you regarding your Fan Inc. Debit Accounts. You agree to maintain such an email address and to promptly notify us of any changes to your email address. To change the email address, we have on file for you, please contact us by email at support@faninc.com by phone at 877-958-2528.

3. Hardware and Software Requirements

By consenting to this Agreement, you confirm that your Access Device meets the minimum system requirements necessary to receive electronic Communications.

To view electronic Communications, you will need:

  • a connection to the Internet;
  • a Current Version (defined below) of an Internet browser we support,
  • a Current Version of a program that accurately reads and displays PDF files (e.g., Adobe Reader),
  • an Access Device and an operating system capable of supporting all of the above.

By “Current Version,” we mean a version of the software that we support and that is currently supported by its publisher. We support the Current Version of Google Chrome, Firefox, Safari, Microsoft Internet Explorer and Microsoft Edge.

You will also need sufficient electronic storage space if you wish to retain Communications in electronic form, and a printer if you wish to print and retain records in paper form.

As permitted by and in accordance with applicable law, we reserve the right to discontinue support of a Current Version of software for any reason, including our opinion that it suffers from a security flaw or other flaw that makes it unsuitable for use.

If our system requirements change, and that change would create a material risk that you would not be able to view or retain your Communications, we will give you notice of the revised requirements. Continuing to use Fan Inc. Debit Accounts is reaffirmation of your consent to this Agreement.

Your acceptance of this Agreement on one Access Device constitutes your acceptance on all Access Devices you use. Additionally, by viewing and accepting this Agreement on any Access Device, you are reasonably demonstrating your ability to access Communications on that Access Device and all subsequent Access Devices. If you change Access Devices (or use multiple Access Devices), it is your responsibility to ensure that the new Access Device meets the applicable system requirements and that you are still able to access and view electronic Communications on the subsequent Access Device.
